On a le droit de s’arrêter sur le trottoir à New York!
Un Américain fait reconnaitre le droit de rester debout au milieu du trottoir. La cour d’appel de New York vient de donner raison à un homme qui avait été interpelé pour avoir refusé de dégager le passage alors qu’il discutait avec des amis sur Times Square à 2h du matin.
La cour d’appel a statué cette semaine en faveur de Matthew Jones, inculpé en juin 2004 pour conduite portant atteinte à l’ordre publique et entrave à une arrestation parce qu’il s’était débattu en agitant les bras lors de son interpellation (ouhla oui, un dangereux personnage ! il a agité les bras !! flinguez le !! appelez Jack Bauer !!). La police avait expliqué que les passants étaient “obligés de le contourner” (il fait 1M 75 pour 80 kg, c’est pas Pierre Menes non plus!) et qu’il avait refusé de se déplacer lorsqu’on le lui avait demandé (un terroriste du trottoir !). Après avoir passé une nuit en garde à vue , Matthew Jones avait plaidé coupable, avant de faire appel.
La cour a estimé que rester debout au milieu du trottoir avec des amis à 2h du matin ne constituait pas une atteinte à l’ordre public. “Sinon, toute personne qui s’arrête sur le trottoir, pour saluer quelqu’un, demander un renseignement ou simplement retrouver son chemin pourrait être soumise à des poursuites”, note la cour qui a jugé l’arrestation contraire à la loi. Au bout de 3 ans quand même… Mais peut-être que les policiers New Yorkais ont eu peur qu’il se fasse électrocuter comme les chiens qui en sont morts, en Février 2006 notamment… Quoi !
